I'm afraid this is a legal issue that I'm not even remotely qualified to comment. In the UK we have the Citizens Advice Bureau who would be able to advise you on this. It would be worth asking around to see if you have any legal equvilent over there in Charlotte NC.

Yes, I am in the process of moving, or was, and of course, it's the same issue w/ apartment renting and carpets. They have give me the run around, from the start, then after asking about condition of apt/carpet, after signing lease, then get keys...I got to smell and see the carpet. I have 4 dogs now, but was only moving out with 2, so I know the symptoms. I'm supposed to move in on Saturday(tomorrow), but told them I find the carpet unacceptable. I'm not paying a bunch of money/deposits on this. Do I have any legs to stand on? Thanks, Tonia in Charlotte NC
